Douglas lifts Sand ban

Gov. Jim Douglas has rescinded his order requiring state police and other state law enforcement officials in Windsor County to send any first-time marijuana possession cases involving significant number of plants or dried weed to the Attorney General or the U.S. Attorney for prosecution or at least initial review.

Douglas dropped this unusual requirement after Sand clarified his policy and practice in handling marijuana cases. Here's the communication from Sand to Susanne Young in the governor's office that helped end the tiff:

I will be on the radio tomorrow and I think someone from the Governor's office may be as well. I hope to make clear that my office does not have a policy and certainly not a blanket policy about diversion in marijuana cases and I intend to apologize if anything I have said has contributed to that perception or misperception. The first time it was reported I had a policy was on WCAX and that then morphed into my having a "blanket policy"

It is my sincere hope that with that clarification and apology we can both find a way to move beyond the Governor's directive and the business of comparing responses in different counties.

If you have any questions about whether we have a blanket policy I would encourage you to speak with attorneys in this County. Each and every case is reviewed individually with an eye toward a fair response. People may disagree on what a fair response is but we seek that goal not based on policy but based on individual case review.

I hope the Governor will seize this opportunity to move forward.

The squabble began because of the way Sand handled the case of a Windsor lawyer charged with possessing 36 marijuana plants and more than two pounds of dry marijuana. Sand referred the case to court diversion, rather than prosecuting the lawyer for a felony.

Douglas said this decision was too lenient and he worried that Sand had a blanket policy to let all first-time marijuana possession cases off the hook. That's why he direct that all the cases he could control as the state's chief executive to someone else other than Sand.

As you can see from Sand's e-mail, there was a misunderstanding about whether Sand had a blanket policy on marijuana cases. Douglas says he now believes Sand won't in the future have a blanket policy. The governor's statement is long, but deep in there he announces he has lifted his Sand ban.

Confronting Vermont’s Substance Abuse Epidemic

Vermont continues to confront a serious drug abuse problem. Too many out of state drug dealers view Vermont as a safe, profitable place to deal their poison. Every elected official has an obligation to evaluate what message their actions send to would-be dealers and when an action or practice fosters this view of Vermont, I have a duty to act.

If you ask anyone in law enforcement, ask anyone in social services, ask a teacher or a principal, ask a parent if drug abuse is a problem in Vermont, and the answer will be a resounding “yes.”

I support a discussion about how to improve our drug laws. Since becoming Governor, my drug education, treatment, enforcement and rehabilitation (DETER) program has been—and continues to be—one of my top priorities.

In my view, diverting all first-time marijuana possession cases regardless of the quantity involved turns a blind-eye to the law and the larger problem of substance abuse in Vermont. Such a practice pushes aside prosecutorial discretion in favor of a one-size-fits-all drug policy.

It is also my view that allowing a public official—who knows the laws and holds others accountable to them—to use court diversion in a case involving substantial quantities and a sophisticated operation to cultivate an illegal substance sends a message that those entrusted to uphold laws only get a slap on the wrist when they violate them. And, as Attorney General William Sorrell said publicly, “If all first-time marijuana possessors and cultivators in Windsor County are treated with diversion, I guess that’s the county in which you ought to be in that business…”

I was heartened to hear on the news last night—and again from him this morning in a communication to my office—that Windsor County State’s Attorney Robert Sand will not have a one-size-fits-all practice or policy for Windsor County. Coupled with his dialogue with Windsor County law enforcement officials, and his acknowledgement that earlier statements may have created the impression of a “blanket policy,” represent a meaningful effort to restore balance in the criminal justice system in that county.

I consider these steps a good faith effort by Mr. Sand, and have decided to lift my order requiring state law enforcement officers to send first-time marijuana possession cases involving significant quantities to the Attorney General or U.S. Attorney for an initial prosecutorial review.

Ultimately, we will succeed in confronting substance abuse by preventing it before it begins. Through my DETER initiative we have invested nearly $22 million to help communities be healthier and safer, and we are educating young Vermonters about the dangers of drugs so they have the strength and courage to refuse them.

DETER has provided Vermont with a sustainable strategy to address today’s substance abuse problems and reduce tomorrow’s risk. It is a multi-faceted effort to address Vermont’s drug epidemic.

Through this program we have put more cops on the beat and more hardcore drug dealers behind bars. We’ve significantly increased capacity for outpatient treatment around the state; added heroin treatment capacity; put drug counselors in our schools and a recovery center in every region; added a new residential treatment facility for women and adolescence, as well as transitional housing for those in recovery; and taken steps to better address the needs of individuals with co-occurring substance abuse and mental health disorders. All together, this is the most coordinated substance abuse prevention program Vermont has ever had. But there is much more to do.

Drugs like heroin, crack cocaine and prescription painkillers—and the out-of-state peddlers who push them—continue to be a problem. Moreover, binge drinking and marijuana use among young people in Vermont continue to be well above national averages. The social and economic cost of substance abuse is severe—contributing significantly to health care costs, crime, domestic violence and other serious social ills.

Our focus needs to remain on preventing substance abuse before it begins. But make no mistake, in word and deed I will stand shoulder-to-shoulder with Vermont’s law enforcement community as we fight those who poison our children for profit.

interesting that you didn't mention anything about the Orange county case sent to diversion by the Republican state's attorney. this was was for 110 plants or something. could it be that jimbo quickly found himself in uncomfortable waters? up against logic, perhaps?
 
Why doesn't Vermont just legalize ALL drugs and pedophilia and start concentrating on serious stuff like trying to start a business without all of the ACT 250 permits or the newly-arrived Volvonistas approval? Sure would make it easier for Vermont judges. Don't worry about the kids, they're just going to move out of state anyways!

I actually like the way it was handled. JD did what he had to do when the event surfaced and then as things evolved maintained an open mind ultimately finding common ground and a solution.

Done like a responsible professional.

I suspect he did what he did because there was the clear appearance that Sands was trying to write law from the Judicial branch. Clearly not his job.

It was the right thing to effectively call a time out until the facts were clear and a responsible conclusion could be drawn and decision made.

Obviously he displayed true open-mindedness by reversing his original position. JD is a man of conviction and integrity; something this State needs and wants.

The only reason he remains Governor is because the election isn't until 11/08.

Douglas didn't have the public's support, or the support of the police and his hypocrisy regarding the case in Windsor County vs. the case in Orange County were so glaring you just know he wants it to go away. He's not a man of integrity. He a politician in the worst sense of the word.

Folks: Sand originally needed to say it was a blanket policy because otherwise it would have looked like he was giving special treatment to a lawyer/judge. Now he says it isn't a blanket policy. So the news media should go back to the original question and ask why the special leniency for a lawyer?

Deciding right and wrong after the fact is easy. He had to make a call based on available facts at the time and remain open-minded enough to adjust his position if newer facts come to light. He did and good for him. That's why VT respects and elects him.

I suspect if JD made the statement 'the sky is blue' there would be an outpouring against the statement just because he is a GOP. And as JW has already told us, GOP=Stupid(even though he has offered no proof just his slanted opinion).

Let's not pretend. There has been nothing but opinion on any of these blogs from the right, left or whatever point of view JWCOOP represents.

As for the who's stupid question take a look at the latest Gallup poll results.

A new Gallup Poll, conducted Dec. 6-9, finds 37% of Americans approving of the job George W. Bush is doing as president, an IMPROVEMENT from his recent scores in the low 30s. Meanwhile, 22% of Americans approve of Congress, essentially unchanged from last month.

At the time of last year's midterm elections, when voters transferred partisan control of Congress from the Republicans to the Democrats, 26% of Americans approved of Congress. After a brief "honeymoon period" at the beginning of the year, and nearly a year after the Democrats took control, Americans' views of Congress are no more positive (and are actually a bit more NEGATIVE) than at the tail end of Republican rule.

So JW...the survey is fact. Bush actually seems to be improving in the view of the US. The Pelosi/Reid coalition seems to be in a continued free fall offering the Country nothing positive. 22% seem to think their leadership is doing a good job... 1 in 5. GW's rating is 68% higher.

So now what is the definition of stupid?

Bubba, I agree. I believe what the poll reflects is that the average rational American has realized the Dems are all talk. They made big assertions and promises then delivered nothing.

Much like the traffic on this board, it is easy to point out all the issues. It is much tougher when you are in the driver's seat and have to make and be accountable for decisions. I suspect few if any of the most opinionated in this crowd have actually been in a position of real responsibility.

It would actually be interesting to understand the demographics of the posters.

I have looked. It is a fine collection of unqualified dairy farmers, shop owners and retired school teachers. A fine crowd to deal with the real issues facing the state.

In a state where we require beauticians and tatto artists to be licensed and qualified we accept a complete lack of qualification to be a member of the legislature.

I think if you look at the accomplishments of the group last year in Montpelier it says it all. Nothing was put forward and nothing was accomplished. What a waste of taxpayer money. The real Vermonters you reference apparently prefer the under qualified. Perhaps its less threatening to you.

As for the Dem Congress failing to deliver, in other words, they haven't been able to overcome Shrub and the gop Senate Minority's veto.

As disappointed as I am with Pelosi and Reid, the biggest problem with Congress is that it's still got too many gops in it who don't give a damn about this Country, Its Troops and are more loyal to the nitwit in chief and their corrupt, intellectually and morally bankrupt party than they are to the Constitution of the United States of America.

Unless and until the gops in Congress start putting Country before Cretin, there's just not enough Dems to override the madness of king george until January of '09.

It's Thurs morning and I just heard Freyne's Q & A with Gov Jim Douglas - it's amazing how the Gov is sidestepping his flap with Bobby Sand and trying to portray as a coming together to move forward.

He actually says he wants to write the last Paragraph to this story... I'll bet he does!

He tried to take a serious issue and use it politically - AND it backfired on him.

Bobby Sand has not changed how he is going about his job - the Governor flip flopped on his position because he jumped into the fray without getting all the facts.

We now know that there have been at least three incidents of Colchester police giving fellow officers free passes when they got caught driving drunk. Instead of a drunk driving charge, the drunk officers were given a free ride home.

Funny, Governor Douglas seems quiet on this one.

I thought he was concerned about equitable application of our laws. And avoiding the appearance that those in positions of authority and trust are above the law.

Shouldn't he be calling for all drunk driving cop cases in Colchester to be referred directly to the Public Safety Commissioner?

I'm disappointed with Gov. Douglas. His "politics first" style is becoming too obvious to ignore or forgive. Especially --such as in the area of drug issues --when it hurts real people.

Bobby Sands, on the other hand, has been acting like a responsible grown up. The same goes for TJ Donovan. Donovan seems to be handling the Colchester police situation directly, but with dignity and restraint. He'd make a good governor.

I feel for the police officers. Their job is stressful on many levels. It would be hard to arrest a friend or fellow officer. Especially knowing that such an arrest would perhaps subject a police officer (and the department) to extra (and sometimes mean-spirited) ridicule.

Driving drunk can be deadly. It's far more serious than possessing or smoking marijuana. But I'd still favor court diversion and job probation for first offenders.

Court diversion isn't a free pass. It's an opportunity to take responsibility for what you've done, and earn a second chance.

Douglas seems to want to end the marijuana discussion because it isn't going his way politically. But he doesn't want to take responsibility for his transgressions or earn a second chance. He wants the free ride. I can't respect that.

Deciding right and wrong after the fact is easy. He had to make a call based on available facts at the time and remain open-minded enough to adjust his position if newer facts come to light. He did and good for him. That's why VT respects and elects him.

I suspect if JD made the statement 'the sky is blue' there would be an outpouring against the statement just because he is a GOP. And as JW has already told us, GOP=Stupid(even though he has offered no proof just his slanted opinion).

At the time of last year's midterm elections, when voters transferred partisan control of Congress from the Republicans to the Democrats, 26% of Americans approved of Congress. Bubba, I agree. I believe what the poll reflects is that the average rational American has realized the Dems are all talk. They made big assertions and promises then delivered nothing.

Much like the traffic on this board, it is easy to point out all the issues. It is much tougher when you are in the driver's seat and have to make and be accountable for decisions. I suspect few if any of the most opinionated in this crowd have actually been in a position of real responsibility.

It would actually be interesting to understand the demographics of the posters.

I have looked. It is a fine collection of unqualified dairy farmers, shop owners and retired school teachers. A fine crowd to deal with the real issues facing the state.

In a state where we require beauticians and tatto artists to be licensed and qualified we accept a complete lack of qualification to be a member of the legislature.

I think if you look at the accomplishments of the group last year in Montpelier it says it all. Nothing was put forward and nothing was accomplished. What a waste of taxpayer money. The real Vermonters you reference apparently prefer the under qualified. Perhaps its less threatening to you.

You are exactly right and in that statement is the fundamental difference in the Parties. GW, Cheney, and all the other Repubs you don't like have made decisions, have had the courage of their convictions and have answered for the consequences of their actions. You may not like these guys but you have to admit they have been consistent in their actions. The Dems on the other hand found it fun to take pot shots at the Administration, talked a big game to get into a leadership role and now that they have to do something, can not. They have turned on themselves and have brought the Congress to its knees. It's not Pelosi's fault it's Reid....no no no it's not Reid, it's Pelosi...no no no it's someone else. C'mon.

That is why in an environment when they could shine and lock in control for years they have blown it because they are acting like the amateurs they are. You see it in the approval ratings posted earlier.

We now know that there have been at least three incidents of Colchester police giving fellow officers free passes when they got caught driving drunk. Instead of a drunk driving charge, the drunk officers were given a free ride home.

Funny, Governor Douglas seems quiet on this one.

I thought he was concerned about equitable application of our laws. And avoiding the appearance that those in positions of authority and trust are above the law.

Shouldn't he be calling for all drunk driving cop cases in Colchester to be referred directly to the Public Safety Commissioner?

I'm disappointed with Gov. Douglas. His "politics first" style is becoming too obvious to ignore or forgive. Especially --such as in the area of drug issues --when it hurts real people.

Bobby Sands, on the other hand, has been acting like a responsible grown up. The same goes for TJ Donovan. Donovan seems to be handling the Colchester police situation directly, but with dignity and restraint. He'd make a good governor.

I feel for the police officers. Their job is stressful on many levels. It would be hard to arrest a friend or fellow officer. Especially knowing that such an arrest would perhaps subject a police officer (and the department) to extra (and sometimes mean-spirited) ridicule.

Driving drunk can be deadly. It's far more serious than possessing or smoking marijuana. But I'd still favor court diversion and job probation for first offenders.

Court diversion isn't a free pass. It's an opportunity to take responsibility for what you've done, and earn a second chance.

Douglas seems to want to end the marijuana discussion because it isn't going his way politically. But he doesn't want to take responsibility for his transgressions or earn a second chance. He wants the free ride. I can't respect that.

Possessing marijuana is illegal. Growing marijuana is illegal. A white upperclass professional, and a professional colleague of the prosecutor, got preferential treatment. You and I would probably be doing jail time for the same offense.

Douglas got it right. "Decriminalization" was never the issue here. The appearance of preferential treatment was the issue.

Readers might want to read today's Caledonian Record editorial regarding the difference in law enforcement between the Northeast Kingdom and leftist meccas such as Windham and Chittenden counties. Nice to know there still is a place where the politically connected face the same justice as the rest of us peons!
